FAIR DEALING DOES NOT EXTEND TO MULTIPLE COPIES

The Copyright Act no. 98 of 1978 governs the use of copyright protected works – those works which authors or any other holder of copyright regard as their sole property.  The author of a literary/artistic work has the exclusive right to authorize or prohibit reproduction of his/her work “in any form or manner”.   Reproduction or copying takes place in different forms e.g. printing, photocopying, scanning, downloading & electronic storage, translating & adapting

Therefore, distribution of the following study material is licensable

  • Course packs / readers, i.e. compilation works containing extracts (text, illustrations, graphics, photographs, etc.) from published sources
  • Single handouts, i.e. journal or magazine articles, or extracts from books, in excess of the reproduction quota determined by the Regulations (section 13 of the Copyright Act)
  • Electronic copies posted / downloaded on the Nelson Mandela University electronic reserves
  • Placing of copies (single items and/or compilation works) in the library’s short loan section (i.e. on reserve) for on-copying by students

 

Transactional Copyright licences are only valid for:

  • The current year - if the material is used again the following year, the license must be renewed.
  • Specific student numbers & course codes as stated on the license (e.g. if the notes are used at more than 1 campus – student numbers and course codes must be included in the application)
  • Dissemination method stipulated on the license (e.g. license for printed notes is not valid for electronic posting or library short loans)
  • Material licensed by DALRO must be printed on campus. 

 

The Nelson Mandela University takes its duty to comply with the Act and related Regulations very seriously; therefore, the Nelson Mandela University Legal Services operate a Copyright Clearance Office to obtain licensing or permission on your behalf.  DALRO clears most of our transactional licenses, quotes take approximately 5 working days and then require approval from the Senior Director of Legal Services.
